Welcome to Downforce 3D. These Terms of Service govern your use of downforce3d.com and any order you place with us. By using this site or placing an order, you agree to these terms. Please read them.
1. Who we are
Downforce 3D sells 3D printed contour-terraced hexagons depicting motorsport circuits. Downforce 3D is a brand of Downforce Media Group, a business based in Gainesville, Georgia, United States. In these terms, "we", "us" and "Downforce 3D" mean Downforce Media Group trading as Downforce 3D. You can reach us at contact@downforce3d.com.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.
3. Products and descriptions
We try to describe and picture every product accurately. Because each hex is 3D printed to order, small variations in finish, layer texture, and colour are normal and are not defects.
Terrain relief on our hexes is vertically exaggerated so that elevation change is visible at desk scale. It is a stylized representation, not a survey-accurate scale model. Circuit routes are simplified for printing and the printed route width does not represent true track width.
4. Circuit names and third-party marks
We use circuit, track, and place names only to identify the location a hex depicts. Downforce 3D is not affiliated with, sponsored by, or endorsed by any circuit, racing series, sanctioning body, team, or event organiser. All trademarks and marks remain the property of their respective owners.
If you believe a product infringes your rights, email contact@downforce3d.com and we will respond promptly.
5. Pricing and payment
Prices are shown in US dollars and may change at any time before you place an order. Promotions and bundle offers may be changed or withdrawn at any time and cannot be applied retroactively to a completed order.
We make every effort to price accurately. If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfil it at that price.
Payment is taken when you place your order. Placing an order is an offer to buy. We accept your order when we send an order confirmation, and we may decline or cancel any order before production begins.
6. Made to order and custom content
Every hex is produced individually for your order. Once your order enters production it cannot be changed or cancelled. Before production begins, email us and we will do our best to accommodate changes.
If you supply content for a custom hex, including engraved text, a route file, or artwork, you confirm that you own it or have permission to use it, and that it does not infringe anyone's rights. You grant us permission to use that content for the sole purpose of producing and fulfilling your order.
We may decline to produce any custom content we consider unlawful, infringing, offensive, or otherwise unsuitable. If we decline, we will refund you in full.
7. Shipping, delivery and risk
We ship to the United States and Canada. Shipping costs, delivery estimates and production times are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees.
Risk of loss passes to you on delivery by the carrier. Canadian customers are responsible for any import duties or taxes assessed on delivery.
8. Returns and refunds
Because every hex is made to order, we do not accept returns or exchanges. Damaged and defective items are replaced free. Our Refund Policy sets out the full terms and forms part of these Terms of Service.
9. Our intellectual property
The designs, models, product photography, text and other content on this site belong to Downforce 3D and are protected by law. You may not reproduce, resell, or create derivative works from our product models or site content without our written permission. Buying a hex gives you ownership of that physical object, not of the underlying design.
10. Acceptable use
Do not use this site to break the law, interfere with its operation, attempt to gain unauthorised access to it, or scrape it at a scale that degrades service for others.
11. Disclaimers
This site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose.
Our hexes are decorative objects. They are not navigational aids, safety equipment, or engineering references, and should not be relied on as any of those.
12. Limitation of liability
To the fullest extent permitted by law, Downforce 3D will not be liable for indirect, incidental, special, or consequential damages arising out of your use of this site or any product bought through it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Some jurisdictions do not allow certain limitations of liability. Where that is the case, the limitations above apply only to the extent permitted.
13. Indemnity
You agree to indemnify Downforce 3D against any claim arising from content you supply to us for a custom order, or from your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in the State of Georgia, and you consent to their jurisdiction.
15. Changes to these terms
We may update these terms from time to time. The version in force is the one published on this page, and the date at the top tells you when it last changed. The terms that apply to your order are the ones in force when you placed it.
16. General
If any part of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with our Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between us.
